Terms and Conditions

These Terms and Conditions govern access to and use of the Movingeasy website, platform, applications, and related services in New Zealand.

Movingeasy is operated by Moving Easy Limited (NZBN 9429049568165), a company incorporated in New Zealand.

1.Nature of the Website

Movingeasy is an online booking website for moving, delivery, transport, and related services.

Movingeasy enables customers to submit Delivery Requests, receive quotes, communicate with service providers, and make bookings through the website.

Movingeasy does not itself provide moving, transport, delivery, packing, loading, unloading, storage, freight, courier, or logistics services.

2.Movingeasy's Role

Movingeasy's role is limited to operating the booking website and related services.

Movingeasy is not a carrier, moving company, transport operator, freight forwarder, warehouse operator, logistics provider, packer, or insurer.

All services booked through Movingeasy are provided by independent third-party service providers, not by Movingeasy.

3.Contract for Services

When a customer accepts a quote or confirms a booking through Movingeasy, the contract for the relevant services is formed directly between the customer and the relevant service provider.

Movingeasy is not a party to that contract.

The relevant service provider is solely responsible for performing the booked services.

4.Independent Service Providers

Service providers using Movingeasy operate independently and on their own behalf.

No service provider is an employee, agent, partner, representative, or subcontractor of Movingeasy.

Nothing in these Terms or in the operation of the website creates any agency, employment, partnership, joint venture, fiduciary, or representative relationship between Movingeasy and any user or service provider.

5.No Guarantee or Endorsement

Movingeasy does not guarantee:

  • that any service provider is suitable, licensed, insured, qualified, reliable, or available;
  • that any quote is accurate, complete, final, or appropriate;
  • that any booking will proceed as requested or quoted; or
  • that any goods will be transported without delay, loss, theft, deterioration, or damage.

Any vetting, verification, profile approval, review, rating, badge, response score, or account status shown on the website is for website purposes only and does not amount to a representation, warranty, guarantee, or assumption of responsibility by Movingeasy.

6.Accounts

Users must provide accurate, current, and complete information and keep their account details secure.

You are responsible for all activity carried out through your account.

Movingeasy may suspend, restrict, or terminate any account, Delivery Request, quote, message, booking, or access to the website at any time if Movingeasy reasonably considers it necessary for fraud prevention, risk management, compliance, safety, website integrity, reputational protection, dispute management, or any breach of these Terms.

7.Delivery Requests and Information

Customers must ensure that all information provided in a Delivery Request is accurate, complete, and not misleading, including pickup and delivery locations, dates, item descriptions, quantity, size, weight, volume, access conditions, fragility, and any special handling requirements.

Movingeasy is not responsible for checking or verifying Delivery Request information.

If any information in a Delivery Request is inaccurate, incomplete, or misleading, the service provider may revise the quote, impose additional charges, refuse to proceed, delay the booking, or cancel the service.

Any consequences arising from inaccurate or incomplete information are the customer's responsibility.

8.Quotes

Quotes shown through Movingeasy are provided by service providers, not by Movingeasy.

A quote may be based on assumptions made from the information supplied by the customer. If the actual job differs from the information supplied, the quote may no longer apply.

Movingeasy is not responsible for quote accuracy, repricing, pricing disputes, or any additional charges raised by a service provider.

9.Payments

Payment for services booked through Movingeasy is arranged directly between the customer and the relevant service provider unless Movingeasy expressly states otherwise.

Movingeasy does not collect, hold, or escrow customer payment for the booked services and is not responsible for non-payment, late payment, refund disputes, chargebacks, or other payment-related issues between a customer and a service provider. Movingeasy may charge service providers separate platform fees or other fees for use of the website.

Any account top-ups, credits, prepaid balances, or similar amounts added to a Movingeasy account for use on the website are final and non-refundable, except where Movingeasy expressly agrees otherwise in writing or where refund is required by applicable law.

10.GST and Tax Compliance

The parties agree that the services supplied by Movingeasy Enterprises Pte. Ltd. under this Agreement are deemed to take place outside New Zealand, in accordance with section 8 of the Goods and Services Tax Act 1985.

If the customer is registered for GST and has entered into this Agreement for the purposes of its taxable activity, the customer must provide Movingeasy Enterprises Pte. Ltd. with its New Zealand GST number to confirm that status. In those circumstances, Movingeasy Enterprises Pte. Ltd. is not required to, and will not, charge GST on the supply.

If the customer is not GST registered, or has not provided its New Zealand GST number, Movingeasy Enterprises Pte. Ltd. is required to charge GST of 15% on the supply under the New Zealand Goods and Services Tax Act 1985.

11.Cancellations and Changes

Bookings may be changed, delayed, cancelled, or refused by the customer or the service provider.

Any cancellation policy, waiting charge, wasted journey fee, redelivery fee, or similar charge is a matter between the customer and the service provider unless Movingeasy expressly states otherwise.

Movingeasy is not responsible for losses arising from cancellation, rescheduling, no-shows, failed collection, failed delivery, delay, lack of access, unsafe conditions, undisclosed items, or inaccurate booking information.

12.Service Provider Responsibility

Each service provider is solely responsible for:

  • the services it offers and performs;
  • compliance with applicable laws, regulations, licences, permits, and safety requirements;
  • its vehicles, labour, subcontractors, and equipment;
  • deciding whether goods are accepted for transport; and
  • any complaint, claim, refund, delay, damage, loss, or dispute relating to the booked service.

Movingeasy does not assume any of those responsibilities.

13.Restricted or Prohibited Goods

Customers must not request the transport of unlawful, hazardous, unsafe, prohibited, or improperly packed goods.

Service providers may refuse to transport any goods they consider unsafe, unlawful, unsuitable, or not as described.

Movingeasy is not responsible for inspecting goods or determining whether goods are lawful, safe, properly packaged, or suitable for transport.

14.Packaging, Access, and Readiness

Unless expressly agreed otherwise between the customer and the service provider, the customer is responsible for ensuring that goods are properly packed and ready for transport, that collection and delivery access is safe and adequate, and that any required permissions or arrangements are in place.

Movingeasy is not responsible for damage, delay, extra cost, or non-performance arising from inadequate packaging, unsafe or restricted access, customer delay, weather exposure, or site conditions.

15.Loss, Damage, Delay, and Non-Performance

Any loss, damage, theft, deterioration, delay, missed timing, failed delivery, failed collection, partial delivery, non-delivery, or other service issue arising out of a booking is solely a matter between the customer and the relevant service provider.

To the maximum extent permitted by law, Movingeasy is not liable for any such matter and is not responsible for investigating, compensating, insuring, or resolving it.

16.Insurance

Movingeasy does not provide insurance for any goods, vehicles, pets, equipment, or other items listed, booked, or transported through the website.

Any insurance held by a service provider is solely a matter between the customer and that service provider.

Customers are responsible for making their own enquiries about insurance and arranging any additional insurance they require.

Movingeasy makes no representation that any insurance exists, is adequate, or will respond to any claim.

17.Reviews, Ratings, and Content

Movingeasy may display reviews, ratings, profile details, response times, account history, verification status, badges, and similar information.

Movingeasy does not guarantee that such information is accurate, complete, representative, current, or free from manipulation.

Movingeasy may remove, edit, suppress, reorder, or decline to publish any content at its discretion.

Users grant Movingeasy a non-exclusive, worldwide, royalty-free licence to use, reproduce, store, publish, modify, and display content submitted through the website for operating, improving, promoting, and protecting the website.

18.Communications and Website Monitoring

Users agree that Movingeasy may send website, operational, support, and transactional communications.

Users also agree that Movingeasy may store, review, analyse, and use communications and records relating to website activity for fraud prevention, support, quality control, moderation, compliance, dispute management, evidence, website improvement, and legal protection.

Movingeasy may use automated systems and AI-assisted tools in connection with customer support, moderation, fraud detection, reminders, follow-ups, and general website operations.

19.Disputes Between Users

Any dispute relating to a booking or service is between the customer and the relevant service provider.

Movingeasy may, but is not obliged to, assist with communications, request information, remove content, or make website-level decisions for risk or operational reasons.

Any such involvement does not make Movingeasy a party to the dispute and does not create any duty for Movingeasy to investigate, adjudicate, resolve, reimburse, or compensate.

20.Prohibited Conduct

Users must not:

  • provide false or misleading information;
  • manipulate quotes, reviews, ratings, or website outcomes;
  • misuse, copy, scrape, harvest, or exploit website data or content;
  • create fake accounts, Delivery Requests, or quotes;
  • use the website unlawfully, abusively, fraudulently, or in a way that harms Movingeasy or other users; or
  • bypass or attempt to bypass Movingeasy in a way intended to avoid applicable fees owed by service providers.

Movingeasy may take any action it considers appropriate in response to such conduct, including suspension, termination, content removal, fee recovery, or legal action.

21.Indemnity

You indemnify Movingeasy and its related entities, directors, officers, employees, contractors, and agents against all claims, demands, liabilities, losses, damages, costs, penalties, and expenses, including legal costs, arising out of or connected with:

  • your use of the website;
  • your breach of these Terms;
  • your Delivery Request, goods, content, conduct, or communications;
  • any dispute between you and another user; and
  • any claim arising from services booked through the website.

22.Limitation of Liability

To the maximum extent permitted by law, Movingeasy is not liable for any loss, damage, cost, or claim arising out of or in connection with the website, any booking, or any services booked through the website.

If Movingeasy is found liable for any reason, its total liability is limited to the amount of fees paid to Movingeasy in connection with the relevant booking.

Movingeasy is not liable for any indirect or consequential loss, including loss of income, profit, business, goodwill, reputation, opportunity, or expected savings.

23.Release

To the maximum extent permitted by law, each user releases Movingeasy from any claim, action, liability, loss, or demand arising out of or connected with:

  • the acts or omissions of another user;
  • any booked service;
  • any quote, cancellation, delay, dispute, damage, loss, theft, or non-performance; or
  • any inaccuracy in user information, reviews, ratings, profile details, or insurance-related information.

24.Consumer Law and Business Users

Nothing in these Terms excludes, restricts, or limits any right or remedy that cannot lawfully be excluded, restricted, or limited.

If you are using Movingeasy for personal, domestic, or household purposes, rights under New Zealand consumer law may apply to the extent relevant.

If you are using Movingeasy for business purposes, then to the maximum extent permitted by law, you and Movingeasy agree to contract out of any law capable of being contracted out of, where the statutory requirements for doing so are satisfied and it is fair and reasonable for the parties to be bound by this clause.

25.Changes to the Website and Terms

Movingeasy may modify, suspend, withdraw, or change any part of the website, its features, or these Terms at any time.

Updated Terms take effect when published on the Movingeasy website.

Continued use of Movingeasy after updated Terms are published constitutes acceptance of the updated Terms.

26.Governing Law

These Terms are governed by the laws of New Zealand.

Subject to any mandatory rights that cannot be excluded, the courts of New Zealand have exclusive jurisdiction in relation to any dispute arising out of or connected with these Terms or the Movingeasy website.
